To: Fatima Simon, whose last place of residence is 13880 Treeline Avenue South, Suite 7, Fort Myers, FL 33913; Janie Simon, whose last place of residence is 5634 Plantation Drive, Toledo, Ohio 43623; and Jimmy Ferguson, whose last place of residence is 5638 Webster Drive, Sylvania, Ohio 43560, each of you will take notice that on the 21st day of March, 2011, the undersigned, Plaintiff filed a Complaint for Foreclosure in Case No. CI0201102354 in the Court of Common Pleas, Lucas County, Ohio alleging that there is due to the Plaintiff the sum of Eighty-six Thousand Four Hundred Two and 55/100 Dollars ($86,402,55) plus interest at the rate of 3.25% (variable) per annum from August 1, 2008, plus late charges and attorney fees applicable to the terms of the Line of Credit Agreement secured by a Mortgage on the real property, which has a street address of 2214 Willow Pond Boulevard, Sylvania, OH 43560, being Permanent parcel No. 79-71398.
The Plaintiff further alleges that by reason of default of said Line of Credit Agreement, the conditions of said Mortgage have been broken and the same has become absolute.
The Plaintiff prays that the Defendants named above be required to answer and set forth any interest in said real property or be forever barred from asserting interest therein, for foreclosure of said mortgage, the marshalling of liens, and the sale of said real property, and that the proceeds of said sale be applied according to law.
THE DEFENDANT(S) ARE REQUIRED TO ANSWER ON OR BEFORE THE 13TH DAY OF SEPTEMBER, 2011.
