C.U. Members Mortgage, a Division of Colonial Savings, F.A., Plaintiff
vs
Pernell E. Mars aka Pernell E. Mars, Sr., et al., Defendants
Aames Capital Corporation dba Aames Home Loan, whose address is unknown is hereby notified that C.U. Members Mortgage, a Division of Colonial Savings, F.A. filed a Complaint in the Common Pleas Court, Lucas County, Ohio in Case No. CI0201006716 against them, alleging that on the 12th day of February, 2002, Pernell E. Mars aka Pernell E. Mars, Sr. and Paulette Mars executed to Maumee Valley Credit Union, a promissory note, which was subsequently assigned to Plaintiff; that the payments on the note are in default, and there is due Plaintiff thereon the sum of $28,767.24 with interest at the rate of 7.125% per annum from the 1st day of May, 2010; that in order to secure the promissory note, Pernell E. Mars aka Pernell E. Mars, Sr. and Paulette Mars executed and delivered to Maumee Valley Credit Union a mortgage deed, which was subsequently assigned to Plaintiff and conveyed the following described real estate:
Situated in the City of Toledo, County of Lucas and State of Ohio and described as follows: Lot number 17 in Winterfeld Addition in the City of Toledo, Lucas County, Ohio, same being recorded in Plats 46-34.
Parcel No. 16-39051; Address: 2324 Avondale Street, Toledo, Ohio.
Plaintiff says that said mortgage was delivered to the Recorder of Lucas County, Ohio on the 20th day of February, 2002, and was recorded in Official Record Volume 02-1184, Page D05, Recorder's Office, Lucas County, Ohio, and is the first and best lien on said premises save the lien of taxes and assessments and the costs of this action.
That by reason of the failure to make the monthly payments as required, the Plaintiff has declared the entire amount due and mortgage securing such note to be absolute; that the Treasurer of Lucas County Ohio may have a claim against said premises. Therefore, Plaintiff prays for judgment in the amount of $28,767.24 with interest at 7.125% per annum from 1st day of May, 2010 plus late charges, advances and penalties; that the mortgage be foreclosed and all equities of redemption be forever cut off; that the Plaintiff be found to have the first and best lien therein; that the priority of all liens be determined by this Court; that said premises be sold as upon execution free and clear of all liens, interest and dower and the proceeds thereof applied to the Plaintiff's claims; and that Plaintiff may have such other and further relief to which it may be entitled at law or in equity.
Defendants first hereinabove named are further notified that they are required to answer said Complaint on or before 3rd day of February, 2011, which includes 28 days from the last publication, or judgment may be rendered as prayed for therein.
