Yolanda P. Grace and Flenoice E. Grace, et al., Defendants
Flenoice E. Grace, whose last known address is 1020 Lincoln, Toledo, Ohio 43607, and if deceased, all heirs, devisees, legatees, executors, executrixes, administrators, administratrixes, assignees, Unknown Spouse(s) of all heirs, devisees, legatees, executors, executrixes, administrators, administratrixes, assignees whose addresses are unknown, will hereby take notice that the 17th day of June, 2010, Beneficial Ohio, Inc. filed its Complaint in Foreclosure and Marshalling of Liens in the Common Pleas Court of Lucas County, Ohio, 700 Adams St., Toledo, OH 43604, being Case No. CI0201004625 against Yolanda P. Grace, et al., praying for judgment of $110,731.42 with interest thereon according to the terms of the note from October 30, 2009, until paid and for foreclosure of said Mortgage Deed on the following described real estate, of which said Defendants Yolanda P. Grace and Flenoice E. Grace are the owners of:
Parcel No. 04-58867; Real estate located at 1020 Lincoln, Toledo Ohio 43607, as further described in Plaintiff's mortgage recorded on July 28, 2005 in 20050728-0054603 of the Mortgage Records of Lucas County, Ohio and the complete legal description may be obtained from the Lucas County Auditor.
And that Defendants Flenoice E. Grace, and if deceased, all heirs, devisees, legatees, executors, executrixes, administrators, administratrixes, assignees, Unknown Spouse(s) of all heirs, devisees, legatees, executors, executrixes, administrators, administratrixes, assignees be required to set up any interest they may have in said premises or be forever barred, that upon failure of said Defendants to pay or cause to be paid said judgment within three days from its rendition that an Order of Sale be issued to the Sheriff of Lucas County, Ohio, to appraise, advertise, and sell said real estate, that the premises be sold free and clear of all claims, liens and interest of any of the parties herein, that the proceeds from the sale of said premises be applied to Plaintiff's judgment and for such other relief to which Beneficial Ohio, Inc. is entitled.
Said Defendants are directed to the Complaint wherein notice under the Fair Debt Collection Practice Act is given.
Said Defendants are required to answer within twenty-eight days after the publication. Said Defendant(s) will take notice that they will be required to answer said Complaint on or before the 8th day of September, 2010, or judgment will be rendered accordingly.
