Jane Doe, Unknown Spouse, if any, of Thomas E. Kriner, whose last place of residence is known as 4645 Lewis Avenue, Toledo, Ohio 43612 but whose present place of residence is unknown, ITT Residential Capital Corporation, whose last place of business is 3300 North Torrey Pines Court, LaJolla CA 92037 and 9275 Sky Park Ct., San Diego CA 92123-4386 but whose present place of business is unknown, will take notice that on June 17, 2009 at 11:13 a.m., Chase Home Finance LLC filed its Complaint in Case No. CI0200904965 in the Court of Common Pleas, Lucas County, Ohio alleging that the Defendants, Jane Doe, Unknown Spouse, if any, of Thomas E. Kriner and ITT Residential Capital Corporation, have or claimss to have an interest in the real estate described below:
Permanent Parcel Number: 20-13009; Property Address: 2001 Rose Arbor Drive, Toledo, Ohio 43614. The legal description may be obtained from the Lucas County Auditor at One Government Center, Suite 600, Toledo, OH 43604. (419) 213-4340.
The Petitioner further alleges that by reason of default of the Defendant(s) in the payment of a promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to secure the payment of said note and conveying the premises described, have been broken, and the same has become absolute.
The Petitioner prays that the Defendant(s) named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshalling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of Petitioner's claim in the proper order of its priority, and for such other and further relief as is just and equitable.
THE DEFENDANT(S) NAMED ABOVE ARE REQUIRED TO ANSWER ON OR BEFORE THE 6TH DAY OF NOVEMBER, 2009.
