Unknown Executors, Administrators, Devisees, Beneficiaries, Heirs, Unknown Spouses of Devisees, Beneficiaries, Heirs, and Creditors of Emily T. Pruss, et al., Defendants
The Unknown Executors, Administrators, Devisees, Beneficiaries, Heirs, Unknown Spouses of Devisees, Beneficiaries, Heirs, and Creditors of Emily T. Pruss, whose place of residence is unknown and who cannot be served within the State of Ohio, will take notice that on June 17, 2009, Fifth Third Bank successor in interest to Fifth Third Bank (Northwest Ohio), ("Plaintiff") filed a Complaint in the Court of Common Pleas of Lucas County, Ohio, in Case No. CI0200904960, against the Estate of Emily T. Pruss and others as Defendants, demanding judgment against the Estate of Emily T. Pruss, principal balance in the amount of Thirteen thousand Forty-seven and 5/100 Dollars ($13,047.05), plus late fees in the amount of One Hundred Forty and 00/100 Dollars ($140.00) plus interest for foreclosure of the Mortgage recorded as Document number 20061211-0081882, Lucas County, Ohio Records; all relating to a certain real property:
Situate in the City of Cincinnati and in the former Village of Winton Place, Hamilton County, Ohio, and being known, numbered and designated as part of Lots Nos. 23, 24, 25 and 26 as shown on the plat of Hand & Decamp's Subdivision of Lot 5 as the same is recorded in Plat Book 4, page 292 of the Plat Records of Hamilton County, Ohio and more particularly being described as follows:
Beginning at a point in the South line of Circle Avenue in Winton Place Cincinnati, Ohio, which point is 68 feet Eastwardly from the Southeast corner of Circle and Station Avenues, as measured along the South line of Circle Avenue, thence East along the South line of Circle Avenue 32 feet to a point; thence South and parallel with Station Avenue 100 feet to a point; thence West parallel with the South line of Circle Avenue 32 feet to a point; thence North along a line parallel with Station Avenue 100 feet to the place of beginning.

Currently set forth as Deed Book Volume 7709, page 2339 recorded 7-24-98. Also commonly known as: 729 Circle Avenue, Cincinnati, Ohio 43213.
The Complaint further demands that all Defendants be required to set forth any claim, lien or interest asserted in the property, or be forever barred; that Plaintiff's Mortgage be declared to be a valid first and best lien upon the property; that Plaintiff's Mortgage be foreclosed; that all liens be marshaled; that the equity of redemption of all Defendants be forever barred, and the property be sold in accordance with law; that upon sale of such property the proceeds be paid to Plaintiff to satisfy the amount of its existing liens and interests, together with its disbursements, advancements and costs, and for such other legal and equitable relief to which Plaintiff may be entitled.
Unknown Executors, Administrators, Devisees, Beneficiaries, Heirs, Unknown Spouses of Devisees, Beneficiaries, Heirs, and Creditors of Emily T. Pruss are further notified that he/she are required to answer the Complaint within twenty-eight (28) days after the last publication of this notice, which will be published once a week for three (3) consecutive weeks, with the last publication to be made on the 27th day of July, 2009.
In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Complaint.
