Unknown Executors, Administrators, Devisees, Beneficiaries, Heirs, Unknown Spouses of Devisees, Beneficiaries, and Heirs and Creditors of Patricia M. Brooks, whose place of residence is unknown and who cannot be served within the State of Ohio, will take notice that on February 21, 2007, Charter One Bank, N.A., ("Plaintiff"), filed a Complaint in the Lucas County Court of Common Pleas, Lucas County, Ohio, in Case No. CI0200702032, against Ronald L. Brooks and others as Defendants, demanding judgment against Ronald L. Brooks in the sum of Fifty-Two Thousand Four Hundred Thirteen and 05/100 Dollars ($52,413.05) plus interest and costs and for foreclosure of the Mortgage recorded as Document number 200701220004685, Lucas County, Ohio, Records; all relating to a certain real property:
Situated in the County of Lucas and State of Ohio, to-wit: Lot number eleven (11) in Prentice's Plat of First Subdivision of Lots two hundred twenty-seven (227) to two hundred thirty-nine (239), inclusive, and Lots numbered two hundred forty-four (244) to two hundred fifty-four (254), inclusive, of W.S. Williams Addition to the City of Toledo, Lucas County, Ohio, in accordance with Volume 12 of Plats, page 15. Parcel No. 12-29571. As currently set forth in Deed Volume 00-341, page C04, recorded 7-10-00. Also commonly known as: 640 Federal Street, Toledo, Ohio 43605.
The Complaint further demands that all Defendants be required to set forth any claim, lien or interest asserted in the property, or be forever barred; that Plaintiff's Mortgage be declared to be a valid first and best lien upon the property; that Plaintiff's Mortgage be foreclosed; that all liens be marshaled; that the equity of redemption of all Defendants be forever barred, and the property be sold in accordance with law; that upon the sale of said property the proceeds be paid to Plaintiff to satisfy the amount of its existing liens and interests, together with its disbursements, advancements, and costs, and for such other legal and equitable relief to which Plaintiff may be entitled.
Unknown Executors, Administrators, Devisees, Beneficiaries, Heirs, Unknown Spouses of Devisees, Beneficiaries, and Heirs and Creditors of Patricia M. Brooks, are further required to answer the Complaint within twenty-eight (28) days after the last publication of this notice, which will be published once a week for six (6) consecutive weeks, with the last publication to be made on the 1st day of June, 2007.
In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Complaint.
