Defendants, James L. Burbridge and Jane Doe, real name Unknown, the unknown spouse of James L. Burbridge, whose last known address is 1126 Prospect, Toledo, Ohio 43606 and JOHN DOE and JANE DOE, real names unknown, The Unknown Heirs, Devisees, Legatees, Administrators, Executors and Assigns of James L. Burbridge, deceased, whose Identities and addresses are unknown, will take notice that on March 16, 2007, Sky Bank, Successor by Merger with United Home Federal, filed its Supplemental Complaint in Case No. CI0200702031 in the Court of Common Pleas, Lucas County, Ohio alleging that the Defendants, James L. Burbridge and Jane Doe, real name Unknown, the unknown spouse of James L. Burbridge, JOHN DOE and JANE DOE, real names unknown, The Unknown Heirs, Devisees, Legatees, Administrators, Executors and Assigns of James L. Burbridge, deceased, have or claim to have an interest in the real estate described below:
Situated in the City of Toledo, County of Lucas and State of Ohio: The Easterly fifteen (15) feet of Lot number one hundred twenty-three (123) and the Westerly twenty (20) feet of Subdivision number five (5) of Lots numbers one hundred twenty-four (124) to one hundred thirty-three (133), both inclusive, on the Plat of Englewood, in the City of Toledo, Lucas County, Ohio. Premises commonly known as: 1126 Prospect Avenue, Toledo, Ohio 43606.
The Plaintiff further alleges that by reason of default in the payment of the promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to secure the payment of said note and conveying the premises described, have been broken, and the same has become absolute.
The Plaintiff demands that the Defendants named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshalling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of Plaintiff's claim in the proper order of its priority, and for such other and further relief as is just and equitable.
THE DEFENDANT(S) NAMED ABOVE ARE REQUIRED TO ANSWER ON OR BEFORE THE 15TH DAY OF JUNE, 2007.
