The CIT Group/Consumer Finance, Inc., Plaintiff
Janet S. Cullars, et al., Defendants
Janet S. Cullars and Ivan S. Cullars, whose place of residence is unknown and who cannot be served within the State of Ohio, will take notice that on November 8, 2007, The CIT Group/Finance, Inc., ("Plaintiff") filed a Complaint in the Court of Common Pleas of Lucas County, Ohio, in Case No. CI0200707339, against Janet S. Cullars and others as Defendants, demanding judgment against Janet S. Cullars in the sum of Fifty-seven Thousand Four Hundred Fifty-seven and 42/100 Dollars ($57,457.42) plus interest and costs and for foreclosure of the Mortgage recorded in Document number 20041201-0096432, Lucas County, Ohio Records; all relating to a certain real property:
The following described real estate Situated in the County of Lucas and State of Ohio, to-wit: the Easterly twenty-seven (27) feet of Lot number three (3), in Block number five (5), in McGrath's Collingwood Park addition to the City of Toledo, Lucas County, Ohio. Parcel no.: 10-02857. Currently set forth in Deed Volume 02-62, page E06, recorded 2-6-02. Commonly known as: 365 O'Connell Street, Toledo, Ohio 43608.
The Complaint further demands that all Defendants be required to set forth any claim, lien or interest asserted in the property, or be forever barred; that Plaintiff's Mortgage be declared to be a valid first and best lien upon the property; that Plaintiff's Mortgage be foreclosed; that all liens be marshaled; that the equity of redemption of all Defendants be forever barred, and the property be sold in accordance with law; that upon sale of such property the proceeds be paid to Plaintiff to satisfy the amount of its existing liens and interests, together with its disbursements, advancements and costs, and for such other legal and equitable relief to which Plaintiff may be entitled.
Janet S. Cullars and Ivan S. Cullars are further notified that he/she are required to answer the Complaint within twenty-eight (28) days after the last publication of this notice, which will be published once a week for six (6) consecutive weeks, with the last publication to be made on the 27th day of March, 2008.
In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Complaint.
