Charter One Bank N.A., Plaintiff
Robert H. Lanning, et al., Defendants
To the defendants, Robert H. Lanning and actual name unknown, present spouse, if any, of Robert H. Lanning, whose last known place of residence and post office address was 30 Merton Street, Holland, Ohio 43528, but whose present residence is unknown and cannot with reasonable diligence be ascertained.
Plaintiff has brought this action naming you as defendants in the above-named Court by filing its Complaint on the 20th day of July, 2007.
The object of the Complaint is to foreclose the equity of redemption under a mortgage against the following described real estate:
Lot number 67 in Haven Park, a Subdivision in Springfield Township, Lucas County, Ohio, same being recorded in Plats 42B-69.
And for a judgment upon promissory notes executed to Charter One Bank, N.A. by Robert H. Lanning, then and as an unmarried person.
The relief demanded is for judgment against the defendant, Robert H. Lanning, in the amounts of Ninety-two Thousand Five Hundred Eighty-two and 72/100 Dollars ($92,582.72), with interest thereon at the rate of 6.25% per annum from February 1, 2007 and for judgment for Seventeen Thousand Eight Hundred Forty-three and 78/100 Dollars ($17,843.78) with interest thereon at the rate of 8.00% per annum from February 1, 2007, until paid; judgment for title costs, costs for protecting the real estate and for court costs; that said mortgage may be foreclosed and the said real estate described herein be sold at Sheriff's Sale and the proceeds of said sale applied for payment of plaintiff's claim; further that defendants, Robert H. Lanning and actual name unknown, present spouse, if any, of Robert H. Lanning, and Lucas County Treasurer, be required to answer setting forth their claim or interest in the subject real estate, if any, or forever be barred from claiming or asserting same; and for such other and further relief to which plaintiff may be entitled.
You are required to answer the Complaint within twenty-eight (28) days after the last publication of this notice, which will be published once a week for six (6) consecutive weeks, with the last publication to be made on the 6th day of March, 2008.
In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Complaint.
