Denise L. Schuette, et al., Defendants
TO all the unknown heirs, devisees, legatees, trustees, successors in title, widows, widowers, executors, administrators, receivers, creditors, assignees and the unknown guardians of minor and/or incompetent heirs of Denise L. Schuette, who is believed and averred to be deceased, and whose last known place of residence and Post Office address was 1413 Almon, Toledo, Ohio 43614, who are unknown and cannot, with reasonable diligence be ascertained: Defendant and Cross-Claimant has brought this action naming you as defendants in the above-named Court by filing its Complaint on the 29th day of August, 2007.
The object of the Cross-Claim is to foreclose the equity of redemption under a mortgage against the following described real estate:
Situated in the City of Toledo, County of Lucas and State of Ohio, Lots numbers Six (6) and Seven (7) in Block number Eight (8) in Glenurban Addition to the City of Toledo, Lucas County, Ohio, same being recorded in Plat 13-37. Parcel Nos. 06-06434 and 06-06437.
And for judgment upon a Credit Agreement and Disclosure executed by Sky Bank, by Marty W. Schuette and Denise L. Schuette, both now deceased.
The relief demanded is an inrem judgment against the Defendants, John Doe, name unknown spouse of Denise L. Schuette, troy E. Schuette, individually and as Administrator of the Estate of Marty W. Schuette, Tracey Schuette, and the unknown heirs, devisees, legatees, executors, administrators, spouses and assigns and the unknown guardians of minor and/or incompetent heirs of Denise L. Schuette, who is believed and averred to be deceased, in the amount of Twenty-four Thousand, Eight Hundred Twenty-four and 40/100 Dollars ($24,824.40), along with interest at the rate of Five and 61/100 Dollars ($5.61) per day from February 6, 2007, until paid, and for court costs; that said mortgage may be foreclosed and the said real estate described herein be sold at Sheriff's Sale and the proceeds of said sale applied for payment of Defendant's, The huntington National Bank successor by merger to Sky Bank, claim; further that Defendants, Troy E. Schuette, individually and as administrator of the Estate of Marty W. Schuette, Jane Doe, the unknown spouse of Troy E. Schuette, Tracey Schuette, James Doe, the unknown spouse of Tracey Schuette, John Doe, the unknown spouse of Denise L. Schuette, and all the unknown heirs, devisees, legatees, trustees, successors in title, widows, widowers, executors, administrators, receivers, creditors, assignees and the unknown guardians of minor and/or incompetent heirs of Denise L. Schuette, who is believed and averred to be deceased, be required to answer setting forth their claim or interest in the subject real estate, if any, or forever be barred from claiming or asserting same; and for such other and further relief to which plaintiff may be entitled.
You are required to answer the Cross-Claim within twenty-eight (28) days after the last publication of this notice, which will be published once a week for six (6) consecutive weeks, with the last publication to be made on the 12th day of February, 2008.
In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Complaint.
