Codie Lee Hobson, deceased, et al., Defendants
Unknown heirs, legatees, devisees, executors, executrixes, administrators, administratrixes and assignees of Codie Lee Hobson, Deceased, and if Deceased, all their heirs, legatees, devisees, executors, executrixes, administrators, administratrixes and assignees, whose addresses are unknown, will hereby take notice that the 8th day of May, 2007, Beneficial Ohio, Inc. filed its Complaint in Foreclosure and Marshalling of Liens in the Common Pleas Court of Lucas County, Ohio, 700 Adams Street, Toledo, Ohio, being Case No. CI0200703492, praying for judgment in the amount of Seventy-Seven Thousand Three Hundred Ninety and 13/100 Dollars ($77,390.13) with interest thereon according to the terms of the note from April 30, 2007 until paid and for foreclosure of said Mortgage Deed on the following described real estate, of which said Defendants are the owners of:
Situated in the City of Toledo, County of Lucas and State of Ohio: and being lot number thirty-eight (38) in Fuller's Hillway Addition, Plat II, in the City of Toledo, Lucas County, Ohio and as further described in Plaintiff's mortgage recorded on January 6, 2006 in Instrument No. 20060106-000380 of the Mortgage Records of Lucas County, Ohio. Also known as: 201 Dickens Drive, Toledo OH 43607.
And that Defendants Unknown heirs, legatees, devisees, executors, executrixes, administrators, administratrixes and assignees of Codie Lee Hobson, Deceased, and if Deceased, all their heirs, legatees, devisees, executors, executrixes, administrators, administratrixes and assignees be required to set up any interest they may have in said premises or be forever barred, that upon failure of said Defendants to pay or cause to be paid said judgment within three days from its rendition that an Order of Sale be issued to the Sheriff of Lucas County, Ohio, to appraise, advertise in the Toledo Legal News, and sell said real estate, that the premises be sold free and clear of all claims, liens and interest of any of the parties herein, that the proceeds from the sale of said premises be applied to Plaintiff's judgment and for such other relief to which Beneficial Ohio, Inc. is entitled.
Said Defendants are directed to the Complaint wherein notice under the fair debt collection practice act is given.
Said Defendants are required to answer within twenty-eight days after the publication. Said Defendants will take notice that you are required to answer said Complaint on or before the 27th day of February, 2008, or judgment will be rendered accordingly.
