The Defendants, Unknown Heirs, Legatees, Devisees, Executors, Administrators and Assigns and the Minor and/or Incompetent Heirs and their Spouses, if any, of Evelyn Callaway, but whose current addresses are unknown, will take notice that on the September 24, 2007, the Plaintiff, Wells Fargo FKA Norwest Bank Minnesota, National Association, as trustee for the registered holder from time to time of First Union Home Equity Loan Trust 1997-1 Home Equity Loan Asset-Backed Certificates, Series 1997-1, filed its Complaint in Case No.: CI0200706378, in the Court of Common Pleas of Lucas County, Ohio, seeking a foreclosure of its mortgage interest in the real property located at 1327 Lincoln Avenue, Toledo, Ohio 43607, ("Real Estate"), and alleged that the Defendants, Unknown Heirs, Legatees, Devisees, Executors, Administrators and Assigns and the Minor and/or Incompetent Heirs and their Spouses, if any, of Evelyn Callaway, have or may have an interest in this Real Estate. The legal description of the Real Estate is attached hereto as Exhibit "A" and made a part hereof:
Situated in the City of Toledo, County of Lucas and State of Ohio:
Lot Number Six Hundred Sixty-three (663) in the Extension of Fairground Addition in the City of Toledo, Lucas County, Ohio. Parcel No. 05-04111.
The Defendants, Unknown Heirs, Legatees, Devisees, Executors, Administrators and Assigns and the Minor and/or Incompetent Heirs and their Spouses, if any, of Evelyn Callaway, are required to answer the Plaintiff's Complaint within twenty-eight (28) days after the last date of publication of this Notice, which will be published once a week for six (6) consecutive weeks, with the last publication to be made on 31st day of December, 2007. In the event that the Defendants, Unknown Heirs, Legatees, Devisees, Executors, Administrators and Assigns and the Minor and/or Incompetent Heirs and their Spouses, if any, of Evelyn Callaway, fail to respond in the allotted time, judgment by default can be entered against them for the relief requested in the Plaintiff's Complaint.
