Unknown Executors, Administrators, Devisees, Beneficiaries, Heirs, Unknown Spouses of Devisees, Beneficiaries and Heirs and Creditors of Arlene F. Lichty, whose place of residence is unknown and who cannot be served within the State of Ohio, will take notice that on January 29, 2007, Charter One Bank, N.A., (\"Plaintiff\"), filed a Complaint in the Lucas County Court of Common Pleas, Lucas County, Ohio, in Case No. CI0200601564, against Unknown Executors, Administrators, Devisees, Beneficiaries, Heirs, Unknown Spouses of Devisees, Beneficiaries and Heirs and Creditors of Arlene F. Lichty and others as Defendants, demanding judgment against the Estate of Arlene F. Lichty in the sum of Eighty-Seven Thousand Forty-five and 63/100 Dollars ($87,045.63) plus interest and costs and for foreclosure of the Mortgage recorded as Document number 200606230041448, Lucas County, Ohio, Records; all relating to a certain real property:
Situated in the Township of Springfield, County of Lucas and State of Ohio: That part of the Southeast 1/4 of the Northwest 1/4 Section 6, Town 2, United States Reserve, Springfield Township, Lucas County, Ohio, more particularly described as follows: Beginning at the Southeast corner of the Northwest 1/4 of said Section 6 and running thence West along the South line of the Northwest 1/4 of said Section 6, a distance of 872.4 feet; thence Northerly to a point on the North line of the Southeast 1/4 of the Northwest 1/4 of said Section 6, that is 884.18 feet West of the East line of the Northwest 1/4 of said Section 6; thence Easterly along the North line of the Southeast 1/4 of the Northwest 1/4 of said Section 6, a distance of 884.14 feet to a point on the East line of the Northwest 1/4 of said Section 6 that is 1321.78 feet North to the point of beginning; thence South along the East line of the Northwest 1/4 of said Section 6, a distance of 1321.78 feet to the point of beginning, excepting therefrom the South 1230 feet thereof. Subject to legal highways. Parcel No. 65-03937, as currently set forth in Deed Instrument No. 200608140053860, recorded 8-14-06. Also commonly known as: 916 Glengary Road, Toledo, Ohio.
The Complaint further demands that all Defendants be required to set forth any claim, lien or interest asserted in the property, or be forever barred; that Plaintiff\'s Mortgage be declared to be a valid first and best lien upon the property; that Plaintiff\'s Mortgage be foreclosed; that all liens be marshaled; that the equity of redemption of all Defendants be forever barred, and the property be sold in accordance with law; that upon the sale of said property the proceeds be paid to Plaintiff to satisfy the amount of its existing liens and interests, together with its disbursements, advancements, and costs, and for such other legal and equitable relief to which Plaintiff may be entitled.
Unknown Executors, Administrators, Devisees, Beneficiaries, Heirs, Unknown Spouses of Devisees, Beneficiaries and Heirs and Creditors of Arlene F. Lichty are required to answer the Complaint within twenty-eight (28) days after the last publication of this notice, which will be published once a week for six (6) consecutive weeks, with the last publication to be made on the 2nd day of April, 2007.
In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Complaint.
