vs
The Unknown Successor Trustee of the Elick Sheronick Living Trust Agreement dated November 22, 1996, et al., Defendants.
The Defendant, The Unknown Successor Trustee of the Elick Sheronick Living Trust Agreement dated November 22, 1996, whose current name and address is unknown, will take notice that on the 31st day of July, 2007, the Plaintiffs, Adib Nour, et al. filed their Complaint in Case No. CI0200705261 in the Common Pleas Court of Lucas County, Ohio. Plaintiffs state that all of the payments have been made pursuant to the terms of the Land Installment Contract dated March 6, 1996, and recorded as Mortgage No. 96-487A12, Lucas County, Ohio Mortgage Records, concerning real estate located at 2174 Broadway, Toledo, Ohio, described as follows:
Lot number Eleven (11) in Douglass & Stahl's subdivision of Lots One (1), Two (2), Three (3), Four (4), Five (5), Six (6), and Seven (7) of Wright & Stebbins addition, in the City of Toledo, Lucas County, Ohio, in accordance with Volume 8 of Plats, Page 73.
Plaintiffs pray that they be granted specific performance of the vendor's required terms and conditions of said Land Installment Contract; that the Defendant be ordered to convey to Plaintiffs by General Warranty Deed all of the right, title and interest of the Land Installment Contract vendors to the Plaintiffs herein, and that failing so to do, that the Court, by appropriate order, direct that the Lucas County Recorder cause the ownership of the above-described real estate to be transferred to the Plaintiffs herein, and that the Lucas County Auditor be ordered to transfer on its records the ownership of the above-described real estate to the Plaintiffs, or, in the alternative, that in the event a successor trustee is appointed, that said trustee be ordered to deliver a good and sufficient Warranty Deed to the Plaintiffs, together with the appropriate transfer tax; that Plaintiffs recover their costs herein expensed, including title expenses and reasonable attorney fees, together with such other and further relief as may be just and equitable.
Defendant is further notified that it is required to answer said Complaint on or before the 18th day of December, 2007, which includes twenty-eight (28) days from the last date of publication, or judgment may be rendered as demanded for therein.
