The Northern Ohio Investment Company, Plaintiff
vs
Joseph M. Garcia, et al., Defendants
TO: Defendant Jane Doe, the unknown spouse, if any, of Joseph M. Garcia, last known address being 1009 Alden Court, Toledo, Ohio 43609, and the current address being unknown.
Plaintiff has brought this action by filing a Complaint for Foreclosure in the Lucas County Court of Common Pleas on July 2nd, 2007, naming you as a Defendant.
The object of the Complaint is to obtain judgment on a Note signed by Joseph M. Garcia and foreclosure of a Mortgage on the following described real property:
Lot number Eight (8) in Broadway Court Addition in the City of Toledo, Lucas County, Ohio, in accordance with Volume 25 of Plats, page 43, except the following part of said lot:
Beginning at a point where the Westerly line of said Lot number Eight (8) intersects the Northerly line of said Lot number Eight (8); thence running Easterly Eight (8) feet along the Northerly line of said Lot number Eight (8); thence Southerly to a point in the boundary line of Broadway Court, which is Three (3) feet Easterly from the Westerly line of said Lot number Eight (8); thence Westerly along the boundary line of said Broadway Court, a distance of Three (3) feet to the Westerly line of said Lot number Eight (8); thence Northerly along the Westerly line of said Lot number Eight (8) to the place of beginning. Parcel No. 02-25301.
The Complaint alleges that Jane Doe, the unknown spouse, if any, of Joseph M. Garcia may have or claim an interest in the property by virtue of dower rights, or otherwise.
The Complaint prays that the Defendant be required to answer and set forth her interest in the real estate or be forever barred from asserting the same, for foreclosure of the Mortgage, the marshalling of any liens, and for the sale of the said real estate, with the proceeds of the said sale to be applied to the payment of the Mortgage and for such other and further relief as is just and equitable.
The Defendant will take notice that she will be required to answer the Complaint on or before the 27th day of November, 2007, or judgment will be rendered accordingly.
