Shannon Deitz, et al., Defendants
Brian Robert Deitz, whose last place of residence is known as 1449 North Ontario Street, Toledo, Ohio 43604-2059 or 1519 Stewart Road Apt 365, Monroe MI 48162-9281, but whose present place of residence is unknown will take notice that on July 13, 2007 at 12:46 p.m., Wells Fargo Bank, NA, as Trustee filed its Complaint in Case No. CI0200704890 in the Court of Common Pleas, Lucas County, Ohio alleging that the Defendant, Brian Robert Deitz has or claims to have an interest in the real estate described below:
Situated in the City of Toledo, County of Lucas and State of Ohio: The Northeasterly thirty-five (35) feet of the Southwesterly ninety-seven (97) feet of Lot number one hundred thirty-nine (39) in STICKNEY'S ADDITION, an Addition in the City of Toledo, Lucas County, Ohio, said property fronting thirty-five (35) feet on Ontario Street and running back a uniform width of thirty-five (35) feet to rear of lot, according to the plat thereof recorded in Volume 15 of Deeds, page 102 of Lucas County Records.
The Petitioner further alleges that by reason of default of the Defendant(s) in the payment of a promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to secure the payment of said note and conveying the premises described, have been broken, and the same has become absolute.
The Petitioner prays that the Defendant(s) named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshalling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of Petitioner's claim in the proper order of its priority, and for such other and further relief as is just and equitable.
THE DEFENDANT(S) NAMED ABOVE ARE REQUIRED TO ANSWER ON OR BEFORE THE 25TH DAY OF OCTOBER, 2007.
