The Court finds that service of summons cannot be made other than by publication on Defendants, Robert M Martin and Unknown Spouse, if any, of Robert M Martin, whose last known place of residence is unknown, each of you will take notice that on November 29, 2018, Plaintiff filed a Complaint for Foreclosure in the Lucas County Court of Common Pleas, being Case No. CI0201804477, alleging that there is due to the Plaintiff the sum of $102,816.95, plus interest at 3.75% per annum from February 1, 2018, plus late charges and attorney fees applicable to the terms of the Promissory Note secured by a Mortgage on the real property, which has a street address of:
4254 Stannard Drive, Toledo, OH 43613, being Permanent Parcel No. 09-25441.
The Plaintiff further alleges that by reason of default of said Promissory Note, the conditions of said Mortgage have been broken and the same has become absolute.
The Plaintiff prays that the Defendants named above be required to answer and set forth any interest in said real property or be forever barred from asserting interest therein, for foreclosure of said mortgage, the marshalling of liens, and the sale of said real property, and that the proceeds of said sale be applied according to law.
Said Defendant(s) are required to file an Answer within twenty-eight (28) days after the last publication, which shall be once a week for three (3) consecutive weeks, or they might be denied a hearing in this case.
