vs
Lourene Word, et al., Defendants
Lourene Word and Unknown Spouse of Lourene Word whose place of residence is unknown and who cannot be served within the State of Ohio, will take notice that on February 16, 2007, Charter One Bank, N.A. ("Plaintiff"), filed a Complaint in the Court of Common Pleas of Lucas County, Ohio, in Case No. CI0200701978, against Lourene Word and others as Defendants, demanding Judgment against Lourene Word in the sum of Forty-five Thousand Eighty-three and 32/100 Dollars ($45,083.32), plus interest and costs and for foreclosure of the Mortgage recorded in Volume 97-3146, Page B04, Lucas County, Ohio Records; all relating to a certain real property:
Situated in the Township of Spencer, County of Lucas and State of Ohio: The North Three (3) acres of the South thirteen (13) acres of the West one-half (1/2) of the Northwest one-quarter (1/4), in Section two (2), Town ten (10) South, Range five (5) East, in Spencer Township, County of Lucas, State of Ohio. Parcel No.: 60-15044. As currently set forth in Deed Volume 1769, page 139, recorded 10-19-60. Also commonly known as: 106 Schwamberger Road, Holland, Ohio.
The Complaint further demands that all Defendants be required to set forth any claim, lien or interest asserted in the property, or be forever barred; that Plaintiff's Mortgage be declared to be a valid first and best lien upon the property; that Plaintiff's Mortgage be foreclosed; that all liens be marshaled; that the equity of redemption of all Defendants be forever barred, and the property be sold in accordance with law; that upon sale of such property the proceeds be paid to Plaintiff to satisfy the amount of its existing liens and interests, together with its disbursements, advancements and costs, and for such other legal and equitable relief to which Plaintiff may be entitled.
Lourene Word and Unknown Spouse of Lourene Word are required to answer the Complaint within twenty-eight (28) days after the last publication of this notice, which will be published once a week for six (6) consecutive weeks, with the last publication to be made on the 8th day of August, 2007.
In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Complaint.
