The unknown heirs, devises, legatees, executors, administrators, personal representatives, spouses, assigns, next of kin and guardians of minor and/or incompetent heirs of Richard R Garner, Jr; Bennie H Garner; Samuel Garner; Edward Garner; Laura E Haynes; Lela Mae Minor; Bertha Mae Stewart; Maryion L Head; and all other persons claiming any legal or equitable right, title estate, lien, or interest in the real property described in this Complaint, et al., Defendants
The unknown heirs, devises, legatees, executors, administrators, personal representatives, spouses, assigns, next of kin and guardians of minor and/or incompetent heirs of Richard R Garner, Jr; Bennie H Garner; Samuel Garner; Edward Garner; Laura E Haynes; Lela Mae Minor; Bertha Mae Stewart; Maryion L Head; and all other persons claiming any legal or equitable right, title estate, lien, or interest in the real property described in this Complaint, all of whose residences are unknown and cannot by reasonable diligence be ascertained, will take notice that on November 7, 2017, Betty V Williams and Minnie Lee Thompson, Plaintiffs, filed a Petition for Partition in the Common Pleas Court of Lucas County, Ohio 700 Adams Street, Toledo, Ohio 43624-1678 as Case No. CI0201704709.
The relief demanded is that partition be made and Plaintiff’s’ interest in the Property be set-off in severalty or, if this cannot be done without manifest injury to the value of the Property, that the Property be appraised and sold and the proceeds paid to Plaintiffs and Defendants as their interest may appear; and
That Plaintiffs be awarded Plaintiff’s attorney fees and costs of this action and such other legal and equitable relief to which Plaintiffs may be entitled, plus the costs of this action.
The person(s) first above mentioned will take further notice that they have been made party Defendant(s) to this action, and that they are required to answer the Complaint within twenty-eight days after last publication, which shall be published once a week for three (3) consecutive weeks, with the last publication to be made on the 25th day of December, 2017.
In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Complaint.
