Lory N Arnold Jr DBA Small Engine Repair, et al., Defendants
To: The Unknown Heirs, Devisees, their Spouses and Creditors, Legatees, and the Fiduciary of the Estate, and Spouse and Creditors, of Lory N Arnold, deceased, whose last known address is unknown and The Unknown Heirs, Devisees, their Spouses and Creditors, Legatees, and the Fiduciary of the Estate, and Spouse and Creditors, of Betty A Arnold, deceased, whose last known address is unknown, each of you will take notice that on the 10th day of July 2015, the Plaintiff filed a Complaint for Foreclosure in Case No. CI0201503304, in the Court of Common Pleas, Lucas County, Ohio alleging that there is due to the Plaintiff the sum of $46,199.41, plus interest, late charges and attorney fees applicable to the terms of the Promissory Note secured by a Mortgage on the real property described as follows:
THE WEST 50 FEET OF THE NORTH 148 FEET OF THE EAST ½ OF THAT PART OF LOT NUMBER 8 LYING SOUTH OF STARR AVENUE IN WOODRUFF’S SUBDIVISION OF THE NORTHEAST ¼ OF THE SOUTHWEST ¼ OF SECTION 6, TOWN 10 SOUTH, RANGE 8 EAST IN THE CITY OF TOLEDO, LUCAS COUNTY, OHIO.
ALSO, THAT PART OF THE EAST 54.346 FEET OF THE NORTH 148 FEET OF THE EAST ½ OF THAT PART OF LOT NUMBER 8 IN WOODRUFF’S SUBDIVISION OF THE NORTHEAST ¼ OF THE SOUTHWEST ¼ OF SECTION 6, TOWN 10 SOUTH, RANGE 8 EAST, LYING SOUTH OF STARR AVENUE IN TOLEDO, LUCAS COUNTY, OHIO, LYING IMMEDIATELY WEST OF THE WEST WALL OF A BUILDING, ERECTED BY FRANK A CROSBY ON SAID PREMISES ABOVE DESCRIBED, BEING A STRIP OF LAND APPROXIMATELY 4 INCHES IN WIDTH, FRONTING ON STARR AVENUE AND APPROXIMATELY 3 INCHES IN WIDTH, AT THE SOUTHERLY BOUNDARY LINE OF THE PREMISES ABOVE DESCRIBED AND LYING BETWEEN THE WEST WALL OF THE BUILDING ERECTED ON SAID PROPERTY FIRST ABOVE DESCRIBED BY FRANK A CROSBY AND THE WEST BOUNDARY LINE OF THE PREMISES FIRST ABOVE DESCRIBED, WHICH STRIP OF LAND IS NOW COVERED ON THE NORTHERLY PORTION THEREOF, BY THE WALL OF THE BUILDING ERECTED BY GRANTOR ON PREMISES, LYING WEST OF THE BUILDING ERECTED BY FRANK A CROSBY ON THE PREMISES FIRST ABOVE DESCRIBED. IT BEING THE INTENTION OF GRANTOR TO CONVEY TO GRANTEE, ITS SUCCESSORS AND ASSIGNS, A STRIP OF LAND LYING WEST OF AND PARALLEL WITH THE WEST BOUNDARY LINE OF THE BUILDING ERECTED BY FRANK A CROSBY ON THE PREMISES FIRST ABOVE DESCRIBED, SAID STRIP OF LAND COMMENCING AT A POINT ON THE NORTHWESTERLY CORNER OF THE PREMISES FIRST ABOVE DESCRIBED, EXTENDING APPROXIMATELY 4 INCHES EAST ON A LINE PARALLEL WITH THE SOUTH LINE OF STARR AVENUE; THENCE SOUTHERLY PARALLEL WITH THE WEST WALL OF THE BUILDING CONSTRUCTED BY FRANK A CROSBY ON THE PREMISES FIRST ABOVE DESCRIBED, TO THE SOUTH BOUNDARY LINE OF SAID PREMISES; THENCE WEST PARALLEL WITH THE SOUTH BOUNDARY OF STARR AVENUE, APPROXIMATELY 3 INCHES TO THE WEST BOUNDARY LINE OF SAID PREMISES, FIRST ABOVE DESCRIBED; THENCE NORTHERLY ALONG THE WEST BOUNDARY LINE OF THE PREMISES FIRST ABOVE DESCRIBED TO THE PLACE OF BEGINNING, EXCEPTING FROM THE ABOVE PROPERTY THE SOUTH 16 FEET CONVEYED TO THE CITY OF TOLEDO, OHIO, FOR ALLEY PURPOSES BY DEED RECORDED IN VOLUME 788 OF DEEDS, PAGE 223.
The Plaintiff further alleges that by reason of default of said Promissory Note, the conditions of said Mortgage have been broken and the same has become absolute.
The Plaintiff prays that the Defendants named above be required to answer and set forth any interest in said real property or be forever barred from asserting interest therein, for foreclosure of said mortgage, the marshalling of liens, and the sale of said real property, and that the proceeds of said sale be applied according to law.
THE DEFENDANT(S) ARE REQUIRED TO ANSWER ON OR BEFORE THE 25TH DAY OF SEPTEMBER, 2015.
