Sky Bank, successor by Merger to Metropolitan Bank & Trust Company, Plaintiff
vs
Cory A. Snyder, et al., Defendants
To the defendants, Financial Credit Corporation, whose last known place of business and post office address was 6985 Miller Road, Warren, Michigan 48092, but whose present business address is unknown and cannot with reasonable diligence be ascertained.
Plaintiff has brought this action naming you as a defendant in the above-named Court by filing its Complaint on the 14th day of March, 2007.
The object of the Complaint is to foreclose the equity of redemption under a mortgage against the following described real estate:
Situated in the Township of Springfield, County of Lucas and State of Ohio: a parcel of land being part of the East 8 acres of the North 13 acres of Section 31, Town 8 North, Range 10 East, in Springfield Township, Lucas County, Ohio, said parcel of land being bounded and described as follows: Commencing at the intersection of the North line of said Section 31, with the East line of said Section 31, said North line of Section 31 also being the centerline of Old Stateline Road, as it now exists, said East line of Section 31 also being the centerline of Crissey Road, as it now exists, said point of intersection being marked with a found monument box; thence in a Southerly direction along said East line of Section 31, having an assumed bearing of South 00º20'10" West, a distance of 100.00 feet to the intersection of a line drawn 100.00 feet Southerly of and parallel with said North line of Section 31, said point of intersection being marked with a set PK nail, said point being the True Point of Beginning; thence South 00º20'10" West along said East line of Section 31, a distance of 204.45 feet to the intersection of the North line of a parcel of land as described in Microfiche 96-500B05, Lucas County Deed Records, said Northerly line of a parcel of land as described in Microfiche 96-500B05, Lucas County Deed Records, also being a line drawn 304.45 feet Southerly of and parallel with said North line of Section 31, said point of intersection being marked with a set PK nail; thence South 90º00'00" West along said Northerly line of a parcel of land as described in Microfiche 96-500B05, Lucas County Deed Records, passing through a set capped pipe at a distance of 25.00 feet, a distance of 191.64 feet to the intersection of a line drawn 191.63 feet Westerly of and parallel with said East line of Section 31, said point of intersection being marked with a set capped iron pipe; thence North 00º20'10" East along said line drawn 191.63 feet Westerly of and parallel with the East line of Section 31, a distance of 204.45 feet to the intersection of said line drawn 100.00 feet Southerly of and parallel with the North line of Section 31, said point of intersection being marked with a set capped iron pipe; thence North 90º00'00" East along said line drawn 100.00 feet Southerly of and parallel with the North line of Section 31, passing through a set capped iron pipe at a distance of 166.64 feet, a distance of 191.64 feet to the True Point of Beginning. Said parcel of land containing an area of 39,180 square feet, or 0.899 acres of land, more or less. Subject to legal highways. Said parcel of land having a present road occupied area of 5,111 square feet or 0.117 acres of land, more or less. The bearings used hereon are based on an assumed meridian and are for the express purpose of calculating angular measurement. Said set capped iron pipe being a 3/4 inch diameter and 30 inch long iron pipe with plastic cap stamped "PS 6842".
And for judgment upon a Promissory Note executed to Plaintiff, Sky Bank, successor by Merger to Metropolitan Bank & Trust Company, by Defendants, Cory A. Snyder and Dawn M. Snyder.
The relief demanded is a judgment against the defendants, Cory A. Snyder and Dawn M. Snyder, in the amount of Sixty-four Thousand Eight Hundred Seventy-five and 22/100 Dollars ($64,875.22), along with interest at the rate of $15.54 per day from October 1, 2004, until paid, and for court costs; that said mortgage may be foreclosed and the said real estate described herein be sold at Sheriff's Sale and the proceeds of said sale applied for payment of Plaintiff's claim; further that defendant, Financial Credit Corporation, be required to answer setting forth their claim or interest in the subject real estate, if any, or forever be barred from claiming or asserting same; and for such other and further relief to which Plaintiff may be entitled.
You are required to answer the Complaint within twenty-eight (28) days after the last publication of this notice, which will be published once a week for six (6) consecutive weeks, with the last publication to be made on the 2nd day of July, 2007.
In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Complaint.
