NOTICE OF U.S. MARSHAL’S SALE: Pursuant to the Judgment of Foreclosure and Order of Sale entered in the action entitled United States of America vs. Jim Hymore, et al., Case No. 3:08cv1428 pending before the United States District Court for the Northern District of Ohio, Western Division, the United States Marshal will set a public sale on the steps of the Lucas County Courthouse, Toledo, Ohio, on May 6, 2009, at 10:00a.m., the property directed therein to be sold and described as follows:
PROPERTY LOCATED AT 2203 GLENDALE AVENUE, TOLEDO, OHIO 43614. LOT NUMBER ONE HUNDRED AND TWENTY-THREE (123) IN WILDWOOD, A SUBDIVISION IN THE CITY OF TOLEDO, LUCAS COUNTY, OHIO, IN ACCORDANCE WITH VOLUME 23 OF PLATS, PAGE 43, EXCEPTING THEREFROM THE NORTH THREE (3) FEET THEREOF, which has the address of 2203 GLENDALE AVENUE, TOLEDO, OHIO 43614.
1. The purchaser, as soon as his bid is accepted, shall be required to deposit with the United States Marshal, in United States currency or by certified check payable to the Clerk of the United States District Court for the Northern District of Ohio, 10% of the amount of the accepted bid. Where the amount bid is $3,000.00 or less, the minimum amount of a deposit shall be $300.00. The maximum amount of a deposit in any case shall be $10,000.00. If such deposit is not so tendered forthwith, the Marshal shall reopen the bidding immediately, starting with the next highest bid, if still available, and continue until a sale is made to a bidder who meets the deposit requirements set forth herein.
2. The unpaid balance of the purchase price shall be due and payable to the United States Marshal within 30 days from the date of sale in United States currency or a certified check payable to the Clerk of the United States District Court for the Northern District of Ohio.
3. A purchaser who fails to pay the entire purchase price to the United States Marshal as provided herein within said 30 days after the date of sale, may be found in contempt of this Court and the deposit made by him shall be forfeited and included in the proceeds of the sale to be distributed as determined by further order of this Court. The subject property shall be re-offered for sale at said purchaser’s expense.
