Notice of Hearing On
Petition for Adoption
Notice must be served not less than 20 days before the date of hearing
To: John Doe, whose whereabouts is unknown and cannot with reasonable diligence be ascertained, through service by publication in Toledo Legal News.
You are hereby notified that on the 14th day of April, 2008, Roberto Avelar, filed in this Court a Petition for Adoption of Emiliano Ricardo Vasquez, a minor, whose date of birth is 06/15/1993, and for change of the name of the minor to Emiliano Avelar. This Court, located at 700 Adams Street, Toledo, Ohio, will hear the petition on the 16th day of June, 2008 at 9:30 a.m.
It is alleged in the Petition, pursuant to R.C. 3107.07, that the consent of John Doe is not required due to the following:
The parent has failed without justifiable cause to communicate with the minor for a period of at least one year immediately preceding the filing of the adoption petition or the placement of the minor in the home of the petitioner.
The parent has failed without justifiable cause to provide for the maintenance and support of the minor as required by law or judicial decree for a period of at least one year immediately preceding either the filing of the adoption petition or the placement of the minor in the home of the petitioner.
