Pursuant to the command of and order directing sale of property issued from the United States District Court, Northern District of Ohio, and directed to Master Commissioner, John N. Graham, shall offer for sale at public auction, in the lobby of the United States District Court for the Northern District of Ohio, Western Division at 1716 Spielbusch Avenue, in the City of Toledo, County of Lucas, and State of Ohio, on
Wednesday, the 13th day of May, A.D. 2008, beginning at 9:00 o’clock, A.M. of said day, the following described lands and tenements to wit:
Situated in the City of Huron, County of Erie and State of Ohio:
Parcel No. 1: Lot Number Fifty-four (54) in Beachwood Cove Subdivision Number Four (4) in the City of Huron, Erie County, Ohio, as per plat recorded in Volume 19 of Plats, page 14, Erie County, Ohio Records.
Parcel No. 2: Situated in the City of Huron, in Erie County, Ohio and being that certain strip of land five feet (5') in width lying adjacent to and immediately northerly of Lot Number 54 in Beachwood Cove Allotment Number 4 as recorded in Volume 19, Page 14 Erie County, Ohio Plat Records together with the right, which shall run with such five foot (5') strip of land, to enter upon the beach property of the Beachwood Cove Association adjacent to such five foot (5') strip of land, for the purpose of repairing and maintaining such retaining wall, with the Grantee or Grantees hereunder and his or their executors, administrators, heirs and assigns being obligated to maintain and repair such retaining wall so that it will not unreasonably interfere with the use of such beach by the Beachwood Cove Association's members and with such Grantee or Grantees and his or their executors, administrators, heirs and assigns, being obligated to restore such beach to the condition that prevailed prior to each instance of repair or maintenance of such wall. Be the same more or less, together with all appurtenances and riparian rights and subject to restrictions, reservations and easements of record and all legal highways, and subject to an easement in favor of the Grantors in, on, over and under the following described portion of said real property, to-wit:
Being situated in the State of Ohio, County of Erie, City of Huron and being more definitely described as follows:
Beginning at a 3/4" iron pipe, found, marking the Southeast corner of Sublot 54 in Beachwood Cove Subdivision No. 4 (PV 19 PG 14);
1) Thence North 56 degrees 59' 08" East along the easterly line of Sublot 54 a distance of 152.40 feet to a 3/8" drill hole, cut, in top of concrete wall;
2) Thence South 62 degrees 10' 00" West a distance of 49.17 feet to a 1/2" iron pin, set;
3) Thence South 55 degrees 05' 00" West a distance of 103.50 feet to a 1/2" iron pin, set, on the North line of Beachside Lane (50 ft.);
4) Thence Southeasterly along the North line of Beachside Lane, along an arc of a curve to the right, having a radius of 75.00 feet, a delta of 00 degrees 45' 50", a chord bearing South 33 degrees 23' 47" East, a chord length of 1.00 foot, an arc length of 1.00 foot to a 3/4" iron pipe, found, and the point of beginning, containing 0.0090 acre, more or less, but subject to all easements and restrictions of record.
The above description was prepared from an actual survey by Daniel E. Hartung, Jr., Professional Surveyor No. 5667 in May 1991. The bearings were assumed only for the purpose of indicating angles. Being more or less but subject to all legal highways.
The above described property is further known as 1013 Beachside Lane, Huron, Ohio. Parcel No. 42-00631
A deposit of CERTIFIED CHECK or CASHIER’S CHECK, payable to Clerk U.S. District Court, or CASH for ten (10%) per cent of the purchase price up to a maximum of $10,000.00 will be required at the time the bid is accepted.
The FULL purchase price shall be paid to Clerk U.S. District Court within THIRTY (30) days from the date of the sale. Failure to do so will result in the purchaser being held in contempt of court.
Property shall be sold for no less than two-thirds of the appraised value.
