Notice Content: LEGAL NOTICE Julie A. Carroll Darling, Attorney In the Common Pleas Court of Lucas County, Ohio, Case No. CI0200702487 Countrywide Home Loans, Inc., Plaintiff vs Ryan O. Hardiman, et al., Defendants To the defendant, Darquette Hardiman, whose place of residence is unknown and whose last known address is 3427 Angela Place, Toledo, OH 43608, and who cannot be served within the State of Ohio, will take notice that on March 14, 2007, Countrywide Home Loans, Inc. filed a Complaint as Plaintiff in the Court of Common Pleas of Lucas County, Ohio, in Case No. CI0200702487 against Ryan O. Hardiman, and others as Defendants, alleging that Defendant, Ryan O. Hardiman, executed and delivered a certain Note, a copy of which is attached to the Complaint and made a part thereof, that there is due to Plaintiff from Defendant, Ryan O. Hardiman, by reason of default under the terms of the Note the unpaid principal balance of Eighty-eight Thousand Five Hundred Sixty-five and 14/100 dollars ($88,565.14) plus interest at the rate of 7.00% per annum from September 1, 2006; that to secure the payment of said Note, Defendant Ryan O. Hardiman, executed and deliverd a Mortgage Deed, thereby conveying the following described premises: The land referred to in this commitment, Situated in the City of Toledo, County of Lucas and State of Ohio, is described as follows: Lot number one hundred seventy-four (174) and the South one-half (1/2) of lot number one hundred seventy-five (175) in John L. Gorny Addition to the City of Toledo, Lucas County, Ohio. Parcel No.: 06-09661. Property commonly known as: 3427 Angela Place, Toledo, Ohio 43608. That said Note is in default, whereby the conditions set forth in said Note and Mortgage have been broken, said Mortgage Deed has become absolute and Plaintiff is entitled to have said Mortgage foreclosed, said premises sold, and the proceeds applied in payment of Plaintiff's claims; that Defendants, Lucas County Treasurer; Unknown Tenant; City of Toledo Department of Public Utilities; and the Clerk of Courts, may have or claim to have some interest in or lien upon said premises; that all of said Defendants be required to set forth any claim, lien or interest in or upon the above described premises which he or she may have or be forever be barred therefrom; that therefore Plaintiff demands judgment against the Defendant Ryan O. Hardiman, in the amount of Eighty-eight Thousand Five Hundred Sixty-five and 14/100 dollars ($88,565.14) plus interest at the rate of 7.00% per annum from September 1, 2006, plus any sums advanced to pay real estate taxes, hazard insurance premiums, property protection and maintenance, plus late charges and interest from the date of such advances; for Plaintiff's cost of evidence of title and for all of its costs herein expended; that the Mortgage referred to be found and adjudged to be a valid and subsisting, first and best lien upon the real estate described herein; that the Mortgage and the Defendants equity of redemption be foreclosed; that all parties hereto answer as to their interests or be forever barred from asserting the same; that all liens be marshaled and their priorities determined; that the premises be sold as if upon execution, and the proceeds of any sale be applied according to law; and for such other relief as is just and equitable. The Defendant, Darquetta Hardiman, is further notified that she is required to answer the Complaint within twenty-eight (28) days after the last publication of this notice, which will be published once a week for six (6) consecutive weeks, with the last publication to be made on the 11th day of July, 2007. In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Complaint.
