vs
Grace E. Wiener, et al., Defendants
TO: Defendants, David A. Meyer Jr., John Doe, the unknown spouse, if any, of Grace E. Wiener and Jane Doe, the unknown spouse, if any, of David A. Meyer Jr., last known address for all of them being 719 Northgate Parkway, Toledo, Ohio 43613, and the current whereabouts of each of them being unknown.
Plaintiff has brought this action by filing a Complaint for Foreclosure in the Lucas County Court of Common Pleas on March 12, 2007, naming you as Defendants.
The object of the Complaint is to obtain judgment on a Note signed by Grace E. Wiener and foreclosure of a Mortgage on the following described real property:
Lot number seventy (70) in Henry W. Bruning's Mayfair Place Plat 2, an Addition in the City of Toledo, Lucas County, Ohio, in accordance with Volume 48 of Plats, page 21. Parcel No.: 02-62231.
The Complaint alleges that Grace E. Wiener and David A. Meyer Jr. are owners of the property.
The Complaint also alleges that John Doe, the unknown spouse, if any, of Grace E. Wiener and Jane Doe, the unknown spouse, if any, of David A. Meyer Jr. may have or claim an interest in the premises by virtue of dower or curtesy rights or otherwise.
The Complaint prays that the Defendants be required to answer and set forth their interests in said real estate or be forever barred from asserting the same, for foreclosure of the Mortgage, the marshalling of any liens, and for the sale of the said real estate, with the proceeds of the said sale to be applied to the payment of the Mortgage and for such other and further relief as is just and equitable.
The Defendants will take notice that they will be required to answer said Complaint on or before the 20th day of July, 2007, or judgment will be rendered accordingly.
