In the Common Pleas Court of Lucas County, Ohio, 700 Adams Street, Lucas County Courthouse, Toledo, Ohio 43604, Case No. CI0200702426
The Northern Ohio Investment Company, Plaintiff
vs
Angeline H. Kowalski, et al., Defendants
TO: Defendants, Angeline H. Kowalski and John Doe, the unknown spouse, if any, of Angeline H. Kowalski, last known address being 5951 W. Benalex, Toledo, Ohio 43612, and Toledo Tree Service Inc., last known address being 2504 Davidson, Sylvania, Ohio, and the current whereabouts of all of them being unknown.
Plaintiff has brought this action by filing a Complaint for Foreclosure in the Lucas County Court of Common Pleas on March 12, 2007, naming you as Defendants.
The object of the Complaint is to obtain judgment on a Note signed by Angeline H. Kowalski and foreclosure of a Mortgage on the following described real property:
Lot number eighty-nine (89) in Benalex Heights, Third Extension, an Addition in the City of Toledo, Lucas County, Ohio, in accordance with Volume 58 of Plats, page 32. Parcel No.: 22-47554
The Complaint alleges that Angeline H. Kowalski owns the property.
The Complaint also alleges that John Doe, the unknown spouse, if any, of Angeline H. Kowalski may have or claim an interest in the premises by virtue of dower rights or otherwise. The Complaint also alleges that Toledo Tree Service, Inc. May have or claim an interest in the Premises by virtue of a Judgment Lien, or otherwise.
The Complaint prays that the Defendants be required to answer and set forth their interests in said real estate or be forever barred from asserting the same, for foreclosure of the Mortgage, the marshalling of any liens, and for the sale of the said real estate, with the proceeds of the said sale to be applied to the payment of the Mortgage and for such other and further relief as is just and equitable.
The Defendants will take notice that they will be required to answer said Complaint on or before the 20th day of July, 2007, or judgment will be rendered accordingly.
