vs
Edward F. Balcar, et al., Defendants
To the defendants, the wives and husbands and former wives and husbands of Anna M. Balcar, if any, whose names are unknown to the Plaintiff and the unknown heirs, devisees, legatees, trustees, successors in title, widows, widowers, executors, administrators, receivers, creditors and assignees of Anna M. Balcar, who is believed andaverred to be deceased, defunct, or dissolved, whose names and last known addresses are unknown and cannot with reasonable diligence be ascertained.
Plaintiff has brought this action naming you as defendants in the above-named Court by filing its Complaint on the 24th day of June, 2010.
The object of the Complaint is to foreclose the equity of redemption under a mortgage against the following described real estate:
Situated in the City of Toledo, County of Lucas and State of Ohio: Lot number Twenty-Seven (27) in Glen Ellyn Park, Plat I, a Subdivision in the City of Toledo, Lucas County, Ohio, same being recorded in Plat 60-42. Parcel No.: 20-30087. Property Address: 1827 Glen Ellyn Drive, Toledo, Ohio 43614. Prior Instrument: Volume 2571, page 138.
And for judgment upon a Promissory Note executed to Plaintiff, Farmers & Merchants State Bank, by Defendants, Edward F. Balcar and Anna M. Balcar, now deceased.
The relief demanded is a judgment against the Defendant, Edward F. Balcar, in the amount of $152,550.80, along with interest at the rate of 6.5% per annum from April 1, 2010, until paid, and for court costs; and judgment against the Defendant, Edward F. Balcar, in the amount of $50,231.00, along with interest at the rate of 6.0% per annum from February 26, 2010; that said mortgages may be foreclosed and the said real estate described herein be sold at Sheriff's Sale and the proceeds of said sale applied for payment of Plaintiff's claim; further that defendants, the wives and husbands and former wives and husbands of Anna M. Balcar, if any, whose names are unknown to the Plaintiff and the unknown heirs, devisees, legatees, trustees, successors in title, widows, widowers, executors, administrators, receivers, creditors and assignees of Anna M. Balcar, who is believed andaverred to be deceased, defunct, or dissolved, be required to answer setting forth their claim or interest in the subject real estate, if any, or forever be barred from claiming or asserting same; and for such other and further relief to which Plaintiff may be entitled.
You are required to answer the Complaint within twenty-eight (28) days after the last publication of this notice, which will be published once a week for three (3) consecutive weeks, with the last publication to be made on the 6th day of August, 2010.
In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Complaint.
