Bayview Loan Servicing, LLC, a Delaware Limited Liability Company, Plaintiff
vs
Theopa J. Overton, et al., Defendants
To: John Soto, and the Unknown Heirs, Executors, Administrators, Assigns and Creditors of John Soto, deceased, whose last known place of residence is Unknown, each of you will take notice that on the 24th day of June, 2010, Plaintiff filed a Complaint for Foreclosure in Case No. CI0201004749 in the Court of Common Pleas, Lucas County, Ohio alleging that there is due to the Plaintiff the sum of $112,283.45 plus accrued interest of $1,867.41, plus interest at at 15.00% (variable) per annum from March 12, 2010, plus late charges and attorney fees applicable to the terms of the Promissory Note secured by a Mortgage on the real property which has a street address of 3249 Stickney Avenue; Vacant Land on Stickney Ave.; 3241 Stickney Ave.; 3239 Stickney Ave.; 3235 Stickney Ave., Toledo, OH 43608 and being permanent parcel Numbers 06-09864; 06-09871; 06-09874; 06-09877; and 06-09881.
The Plaintiff further alleges that by reason of default in the payment of said Promissory Note, the conditions of said Mortgage have been broken and the same has become absolute.
The Plaintiff prays that the Defendants named above be required to answer and assert any interest in said real property or be forever barred from asserting any interest therein, for foreclosure of said mortgage, the marshalling of liens, and the sale of said real property, and that the proceeds of said sale be applied according to law.
THE DEFENDANT(S) ARE REQUIRED TO ANSWER ON OR BEFORE THE 2ND DAY OF SEPTEMBER, 2010.
