Tony J. Cochenour, et al., Defendants.
Mego Mortgage nka Altiva Financial Corp. whose address is unknown and who cannot be served within the State of Ohio, will take notice that on January 8, 2010, RBS Citizens, NA successor by merger to Charter One Bank, NA (“Plaintiff”), filed a Complaint in the Court of Common Pleas of Lucas County, Ohio, in Case No. CI0201001135, against Tony J. Cochenour and others as Defendants, demanding Judgment against Tony J. Cochenour in the sum of $92,397.88 plus interest and costs and for foreclosure of the Mortgage recorded in Document Number 200705627-0038255, Lucas County, Ohio Records; all relating to a certain real property:
LOT NUMBER 198 IN FULLER'S CREEKSIDE GLENS, PLAT II, A SUBDIVISION IN WASHINGTON TOWNSHIP, LUCAS COUNTY, OHIO, SAME BEING RECORDED IN VOLUME 59 OF PLATS, PAGE 28. PARCEL NUMBER: 84-19761; CURRENTLY SET FORTH IN INSTRUMENT NUMBER 20040312-0018538, RECORDED 3-12-04. COMMONLY KNOWN AS: 6153 BAHIAMAR ROAD, TOLEDO OHIO 43611.
The Complaint further demands that all Defendants be required to set forth any claim, lien or interest asserted in the property, or be forever barred; that Plaintiff’s Mortgage be declared to be a valid first and best lien upon the property; that Plaintiff’s Mortgage be foreclosed; that all liens be marshaled; that the equity of redemption of all Defendants be forever barred, and the property be sold in accordance with law; that upon sale of such property the proceeds be paid to Plaintiff to satisfy the amount of its existing liens and interests, together with its disbursements, advancements and costs, and for such other legal and equitable relief to which Plaintiff may be entitled.
Mego Mortgage nka Altiva Financial Corp. is further notified that they are required to answer the Complaint within 28 days of the last publication of this Notice which will be published once a week for (3) consecutive weeks, the last publication date being the 18th day of March, 2010, or judgment may be rendered against him/her as demanded by Plaintiff.
