Unknown Heirs at Law, Devisees, Legatees, Executors or Administrators of James Hall, whose last place of residence is known as Address Unknown. but whose present place of residence is unknown will take notice that on October 18, 2006, Deutsche Bank National Trust Company, as Trustee of Ameriquest Mortgage Securities, Inc., Asset-Backed Pass Through Certificates, Series 2003-X3, Under the Pooling & Servicing Agreement dated as of September 1, 2003 filed its Complaint in Foreclosure in Case No. CI0200606466 in the Court of Common Pleas, Lucas County, Ohio alleging that the Defendants, Unknown Heirs at Law, Devisees, Legatees, Executors or Administrators of James Hall, have or claim to have an interest in the real estate described below:
Situated in the City of Toledo, County of Lucas and State of Ohio, to-wit: Lot number forty-one (41) in the Subdivision of Lots Numbers thirty-seven (37), thirty-eight (38), thirty-nine (39), forty (40), forty-one (41), forty-two (42), forty-three (43) and forty-four (44) in Funk's Addition, in the City of Toledo, Lucas County, Ohio, according to the Plat thereof recorded in Volume 16 of Plats, page 38 of Lucas County Records. Subject to legal highways. Parcel No. 05-21187. Property Address: 1633 Western Avenue, Toledo OH 43609.
The Petitioner further alleges that by reason of default of the Defendant(s) in the payment of a promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to secure the payment of said note and conveying the premises described, have been broken, and the same has become absolute.
The Petitioner prays that the Defendant(s) named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshalling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of Petitioner's claim in the proper order of its priority, and for such other and further relief as is just and equitable.
THE DEFENDANT(S) NAMED ABOVE ARE REQUIRED TO ANSWER ON OR BEFORE THE 29TH DAY OF JUNE, 2007.
