M. Gillen aka Mark Gillen, et al., Defendants
TO: Defendants, M. Gillen aka Mark Gillen and Jane Doe, the unknown spouse, if any, of M. Gillen aka Mark Gillen, last known address for each being 374 Countryside Drive, Roselle, IL 60172 and John Does #1-5, the unknown tenants, lessees and occupants of 2215 Collingwood Avenue, Toledo, Ohio 43620, last known address being 2215 Collingwood, Toledo, Ohio 43620, and the current address for all of them being unknown.
Plaintiff has brought this action by filing a Complaint for Foreclosure in the Lucas County Court of Common Pleas on December 8, 2006, naming you as Defendants.
The object of the Complaint is to obtain judgment on a Note signed by M. Gillen aka Mark Gillen and foreclosure of a Mortgage on the following described real property:
Situated in the East 1/2 of the Southwest 1/4 of Section 26, Town 9 South, Range 7 East, in the City of Toledo, County of Lucas and State of Ohio, and bounded and described as follows: Beginning at a point in the West line of Collingwood Avenue, 100 feet North of the North line of Bancroft Street; thence North on the West line of Collingwood Avenue 95 feet; thence West on a line parallel with Bancroft Street, 300 feet; thence South on a line parallel with Collingwood Avenue, 95 feet; and thence East on a line parallel with Bancroft Street, to the place of beginning. Parcel No. 18-39331.
The Complaint alleges that Jane Doe, the unknown spouse, if any, of M. Gillen aka Mark Gillen may have or claim an interest in the property by virtue of dower rights or otherwise. The Complaint also alleges that John Does #1-5, the unknown tenants, lessees and occupants of 2215 Collingwood Avenue, Toledo, Ohio 43620, may have or claim an interest in the property by virtue of a lease or other rental agreement or otherwise.
The Complaint prays that the Defendants be required to answer and set forth their interests in said real estate or be forever barred from asserting the same, for foreclosure of the Mortgage, the marshalling of any liens, and for the sale of the said real estate, with the proceeds of the said sale to be applied to the payment of the Mortgage and for such other and further relief as is just and equitable.
The Defendants will take notice that they will be required to answer said Complaint on or before the 19th day of June, 2007, or judgment will be rendered accordingly.
