Deighton, Attorney In the Common Pleas Court of Lucas County, Ohio, Case No. CI0200804035 Countrywide Home Loans, Inc., fka, Countrywide Funding Corporation, dba America's Wholesale Lender, Plaintiff vs Robin L. Alcock, et al., Defendants Defendant, Erie West Mortgage Company, whose last known address is 4303 Talmadge Road, Suite 202, Toledo, Ohio 43623, will take notice that on May 13, 2008, Countrywide Home Loans, Inc., fka, Countrywide Funding Corporation, dba America's Wholesale Lender, filed its Complaint in Case No. CI0200804035 in the Court of Common Pleas, Lucas County, Ohio alleging that the Defendant, Erie West Mortgage Company, has or claims to have an interest in the real estate described below: Situated in the City of Toledo, County of Lucas and State of Ohio: Lot number 12 in Queens Acres, an Addition in the City of Toledo, Lucas County, Ohio, same being recorded in Volume 50 of Plats, page 45. Premises commonly known as: 5934 Midwest Avenue, Toledo, Ohio 43613. The Plaintiff further alleges that by reason of default in the payment of the promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to secure the payment of said note and conveying the premises described, have been broken, and the same has become absolute. The Plaintiff demands that the Defendants named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshalling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of Plaintiff's claim in the proper order of its priority, and for such other and further relief as is just and equitable.
