Hogan, Attorney In the Common Pleas Court of Lucas County, Ohio, Case No. CI0200706237 JP Morgan Chase Bank, N.A., successor by merger with Bank One, N.A., Plaintiff vs John I. Sherry, et al., Defendants Cheryl R. Sherry, whose last known address is 1375 Holmes, Toledo, OH 43605, will take notice that on 17th day of September, 2007, Plaintiff filed its Complaint in Case No. CI0200706237 in the Court of Common Pleas, Lucas County, Ohio alleging that the Defendants have or claim to have an interest in the real estate commonly known as 1375 Holmes, Toledo, Ohio 43605, and also known as Parcel Number 03-15431 of the Auditor's Records of Lucas County, Ohio. Said parcel more particularly described in Exhibit "A" attached to Plaintiff's mortgage filed in official record book, 99-1517, page D09 on the 26th day of April, 1999, which was thereafter assigned and recorded in book 00-1533, page B10 on the 10th day of May, 2000 in the Recorder's Office of Lucas County, Ohio. The Complaint further alleges that by reason of default of the Defendant(s) John I. Sherry and Cheryl R. Sherry in the payment of a promissory note, according to its tenor, the conditions of a mortgage deed given to it to secure the payment of said note and conveying the premises described therein have been broken, and the same has become absolute. The Complaint further prays that the Defendant(s) named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshalling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of Bank One's claim in the proper order of its priority, and for such other and further relief as is just and equitable.
