Unknown Executors, Administrators, Devisees, Beneficiaries, Heirs, Unknown Spouse of Devisees, Beneficiaries, Heirs and Credits of Frank Grace, et al., Defendants
Unknown Executors, Administrators, Devisees, Beneficiaries, Heirs, Unknown Spouse of Devisees, Beneficiaries, Heirs and Credits of Frank Grace, whose place of residence is unknown and who cannot be served within the State of Ohio, will take notice that on March 28, 2007, Mortgage Electronic Registration Systems, Inc., as nominee for The CIT Group/Consumer Finance Inc. ("Plaintiff"), filed a Complaint in the Lucas County Court of Common Pleas, Lucas County, Ohio, in Case No. CI0200702751, against Unknown Executors, Administrators, Devisees, Beneficiaries, Heirs, Unknown Spouse of Devisees, Beneficiaries, Heirs and Credits of Frank Grace and others as Defendants, demanding judgment against the estate of Frank Grace in the sum of Forty-six Thousand Forty-seven and 69/100 Dollars ($46,047.69) plus interest and costs and for foreclosure of the Mortgage recorded as Document number 200506090041123, Lucas County, Ohio, Records; all relating to a certain real property:
Lot number one hundred six (106) in John C. Clarke's Addition to the City of Toledo, Lucas County, Ohio. Parcel No.: 03-13147. As currently set forth in Deed Instrument No. 200702120008595, recorded 2-12-07. Also Commonly known as: 1144 Indiana Avenue, Toledo, Ohio.
The Complaint further demands that all Defendants be required to set forth any claim, lien or interest asserted in the property, or be forever barred; that Plaintiff's Mortgage be declared to be a valid first and best lien upon the property; that Plaintiff's Mortgage be foreclosed; that all liens be marshaled; that the equity of redemption of all Defendants be forever barred, and the property be sold in accordance with law; that upon the sale of said property the proceeds be paid to Plaintiff to satisfy the amount of its existing liens and interests, together with its disbursements, advancements, and costs, and for such other legal and equitable relief to which Plaintiff may be entitled.
Unknown Executors, Administrators, Devisees, Beneficiaries, Heirs, Unknown Spouse of Devisees, Beneficiaries, Heirs and Credits of Frank Grace are further required to answer the Complaint within twenty-eight (28) days after the last publication of this notice, which will be published once a week for six (6) consecutive weeks, with the last publication to be made on the 16th day of May, 2007.
In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Complaint.
