Kimberly J. Smith aka Kimberly J. Smyth, et al., Defendants
TO: Defendants, Kimberly J. Smith aka Kimberly J. Smyth and John Doe, the unknown spouse, if any, of Kimberly J. Smith aka Kimberly J. Smyth, last known address being 219 N. California, Toledo, Ohio 43612, and the current address being unknown.
Plaintiff has brought this action by filing a Complaint for Foreclosure in the Lucas County Court of Common Pleas on December 24, 2006, naming you as Defendants.
The object of the Complaint is to obtain judgment on a Note signed by Kimberly J. Smith aka Kimberly J. Smyth and foreclosure of a Mortgage on the following described real property:
Lot number 338 in North Collingwood Park, a Subdivision in the City of Toledo, Lucas County, Ohio, same being recorded in Plats 32-21. Parcel No. 22-84121.
The Complaint alleges that John Doe, the unknown spouse, if any, of Kimberly J. Smith aka Kimberly J. Smyth may have or claim an interest in the property by virtue of dower rights or otherwise.
The Complaint prays that the Defendants be required to answer and set forth their interests in said real estate or be forever barred from asserting the same, for foreclosure of the Mortgage, the marshalling of any liens, and for the sale of the said real estate, with the proceeds of the said sale to be applied to the payment of the Mortgage and for such other and further relief as is just and equitable.
The Defendants will take notice that they will be required to answer said Complaint on or before the 6th day of June, 2007, or judgment will be rendered accordingly.
