Kathryn S. Cox fka Kathy Borders, et al., Defendantss
TO: Defendants, Kathryn S. Cox fka Kathy Borders and Kristoffer Cox, last known address being 601 Prouty, Toledo, Ohio 43609, and the current address being unknown.
Plaintiff has brought this action by filing a Complaint for Foreclosure in the Lucas County Court of Common Pleas on December 21, 2007, naming you as Defendants.
The object of the Complaint is to obtain judgment on a Note signed by Kathryn S. Cox fka Kathy Borders and foreclosure of a Mortgage on the following described real property:
The east one-half (1/2) of that part of Lot number sixty-five (65) in Stocking's Addition to the City of Toledo, Lucas County, Ohio, in accordance with Volume 3 of Plats, page 6, which is bounded and described as follows: Beginning at a point on the east line of said lot sixty-five (65) that is ninety-seven and six tenths (97.6) feet south of the northeast corner of said lot; thence north along the east line of said lot, ninety-seven and six tenths (97.6) feet to the northeast corner of said lot; thence west along the north line of said lot to the northwest corner of said lot; thence south along the west line of said lot ninety-seven (97) feet; thence east in a direct line to the place of beginning. Parcel No. 14-34777.
The Complaint alleges that Kristoffer Cox, the Spouse of Kathryn S. Cox fka Kathy Borders may have or claim an interest in the property by virtue of dower rights or otherwise.
The Complaint prays that the Defendants be required to answer and set forth their interests in said real estate or be forever barred from asserting the same, for foreclosure of the Mortgage, the marshalling of any liens, and for the sale of the said real estate, with the proceeds of the said sale to be applied to the payment of the Mortgage and for such other and further relief as is just and equitable.
The Defendants will take notice that they will be required to answer said Complaint on or before the 21st day of May, 2008, or judgment will be rendered accordingly.
