The CIT Group/Consumer Finance, Inc.,, Plaintiff
vs
Richard A. Wisbon, et al., Defendants
Unknown Spouse of Loni D. Wisbon whose place of residence is unknown and who cannot be served within the State of Ohio, will take notice that on May 11, 2007, The CIT Group/Consumer Finance, Inc. ("Plaintiff"), filed a Complaint in the Court of Common Pleas of Lucas County, Ohio, in Case No. G-4801-CI-200703562, against Richard A. Wisbon and Loni D. Wisbon and others as Defendants, demanding Judgment against Richard A. Wisbon and Loni D. Wisbon, jointly and severally in the sum of One Hundred Fifty-one Thousand, Eighty-six and 71/100 ($151,086.71) plus interest and costs and for foreclosure of the Mortgage recorded in Document Number 20050801-0055398, Lucas County, Ohio Records; all relating to a certain real property:
Lot Number Two Hundred Ninety-three (293), in Lincoln Green, Plat 3, a Subdivision in Springfield Township, Lucas County, Ohio, in accordance with Volume 58 of Plats, Page 79. Parcel no. 65-62977.
Currently set forth in deed Volume 99-133, Page A01, Recorded 3-19-99. Commonly known as: 125 Danesmoor Road, Holland, Ohio 43528.
The Complaint further demands that all Defendants be required to set forth any claim, lien or interest asserted in the property, or be forever barred; that Plaintiff's Mortgage be declared to be a valid first and best lien upon the property; that Plaintiff's Mortgage be foreclosed; that all liens be marshaled; that the equity of redemption of all Defendants be forever barred, and the property be sold in accordance with law; that upon sale of such property the proceeds be paid to Plaintiff to satisfy the amount of its existing liens and interests, together with its disbursements, advancements and costs, and for such other legal and equitable relief to which Plaintiff may be entitled.
Unknown Spouse of Loni D. Wisbon is further notified that he/she is required to answer the Complaint within twenty-eight (28) days after the last publication of this Notice, which will be published once a week for six (6) consecutive weeks, with the last publication to be made on the 6th day of February, 2008.
In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Complaint.
