vs
Brian S. Kohl, et al., Defendants
TO: Defendants, Brian S. Kohl and Jane Doe, the unknown spouse, if any, of Brian S. Kohl, last known address for each them being 423 Eastern Avenue, Toledo, Ohio 43609, and the current whereabouts of each of them being unknown.
Plaintiff has brought this action by filing a Complaint for Foreclosure in the Lucas County Court of Common Pleas on January 8, 2007, naming you as Defendants.
The object of the Complaint is to obtain judgment on a Note signed by Brian S. Kohl and foreclosure of a Mortgage on the following described real property:
Lot number 261 in Daniel's Addition in the City of Toledo, Lucas County, Ohio, same being recorded in Plats 4-5. Parcel No. 04-02401.
The Complaint alleges that Brian S. Kohl is the owner of the property.
The Complaint also alleges that Jane Doe, the unknown spouse, if any, of Brian S. Kohl may have or claim an interest in the premises by virtue of dower or courtesy rights or otherwise.
The Complaint prays that the Defendants be required to answer and set forth their interests in said real estate or be forever barred from asserting the same, for foreclosure of the Mortgage, the marshalling of any liens, and for the sale of the said real estate, with the proceeds of the said sale to be applied to the payment of the Mortgage and for such other and further relief as is just and equitable.
The Defendants will take notice that they will be required to answer said Complaint on or before the 7th day of May, 2007, or judgment will be rendered accordingly.
