Andres, Defendant SUMMONS WITH NOTICE ACTION FOR DIVORCE To the above named Defendant, JENNIFER A. ANDRES: YOU ARE HEREBY SUMMONED to serve a notice of appearance on the Plaintiff's Attorney, Daniel R. McComb, Esq. 206 East Main Street, Batavia, New York 14020, (585) 343-2250, within 20 days after the service of this summons, exclusive to the day of service (or within 30 days after the service is complete if this summons is not personally delivered to you within the State of New York); and in case of your failure to appear, judgment will be taken against you by default for the relief demanded in the notice set forth below. NOTICE: The nature of this action is to dissolve the marriage between the parties, on the grounds of ABANDONMENT. The relief sought is the following: 1. A judgment of absolute Divorce in favor of the Plaintiff dissolving the marriage between the parties in this action; 2. Custody and Child Support of the minor child of the parties per prior order of court of Cayuga County, OH filed on 8-23-96 giving custody to the defendant, Jennifer A. Andres and ordering the plaintiff, James E. Andres, to pay child support in the amount of $212.50 per month; 3. Property in the possession of defendant shall remain her sole and separate property, and any property in the possession of the plaintiff shall remain his sole and separate property; 4.
